By downloading, installing, or using Penlock ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
Tony Bach ("we," "us," or "our") grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, subject to Apple's usage rules set forth in the App Store Terms of Service and these Terms.
Penlock is available as a one-time purchase through the Apple App Store. Upon completing your purchase:
You retain full ownership of all content you create within the App, including journal entries, photos, tags, and any other data. Since all content is stored locally on your device, you are solely responsible for maintaining backups of your data.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, in no event shall Tony Bach be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory.
Since all data is stored locally on your device, we are not responsible for any data loss resulting from device failure, damage, loss, or any other cause. We recommend regularly exporting your journal entries as a backup.
The App, including its design, code, graphics, logos, and all related intellectual property, is owned by Tony Bach and is protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
We reserve the right to terminate or suspend your license to use the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.
We may update these Terms from time to time. Any changes will be reflected on this page with an updated "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
